1. Introduction

This Privacy Policy explains how Fogeni, operated by `Fogeni` (“Fogeni,” “we,” “us,” or “our”), collects, uses, shares, retains, and protects personal information when you use our website, account system, photo-processing tools, subscriptions, and related services.

2. Information we collect

We may collect:

### Account information

  • name;
  • email address;
  • password credentials in protected or hashed form;
  • account identifiers;
  • verification status; and
  • subscription, credit, and account preferences.

### User Content

  • uploaded photographs and bracketed exposures;
  • processed and edited images;
  • reference images;
  • prompts and editing instructions;
  • image metadata; and
  • download and editing history.

### Transaction information

  • selected plan or top-up;
  • payment status;
  • transaction, invoice, refund, and subscription identifiers;
  • billing country and applicable tax information; and
  • limited payment details provided by our payment provider.

We do not directly store complete payment-card numbers when payments are handled by Paddle or another payment provider.

### Technical and usage information

  • IP address;
  • device, browser, and operating-system information;
  • login, access, and security logs;
  • pages, buttons, and features used;
  • processing status, errors, and performance data;
  • cookies and similar technologies; and
  • communications with support.

3. How we use information

We use personal information to:

  • create, verify, secure, and administer accounts;
  • process uploaded photos and deliver completed outputs;
  • maintain private user libraries and editing history;
  • manage credits, subscriptions, renewals, cancellations, top-ups, and refunds;
  • process payments and prevent duplicate or fraudulent transactions;
  • provide support and service communications;
  • monitor reliability, troubleshoot failures, and improve performance;
  • detect abuse, fraud, security threats, and violations of our Terms;
  • comply with legal, tax, accounting, regulatory, and law-enforcement obligations; and
  • establish, exercise, or defend legal claims.

Where applicable, our legal bases may include performing our contract with you, complying with law, pursuing legitimate interests such as service security and improvement, and obtaining consent where required.

4. How we share information

We may share information only as reasonably necessary with:

  • AI and infrastructure providers, including providers used to process images, host data, deliver the Service, monitor performance, or provide secure storage;
  • payment and billing providers, including Paddle, which may act as merchant of record and independently process payment, tax, fraud, refund, and billing information;
  • authentication, email, analytics, and support providers used to operate the Service;
  • professional advisers, such as lawyers, accountants, auditors, and insurers;
  • authorities or other parties where required by law, court order, valid legal process, or to protect rights, safety, and security; and
  • a successor or transaction party in connection with a merger, financing, acquisition, reorganization, or sale of all or part of the business, subject to appropriate safeguards.

We do not sell users’ private photographs. We do not permit one user to view another user’s private photos, editing history, credits, or billing information.

5. AI processing

Uploaded photos, prompts, and related information may be transmitted to third-party AI providers to generate or edit images. These providers process data according to their contractual terms and privacy commitments.

Do not upload highly sensitive personal information unless it is necessary and you have the legal right to do so. You are responsible for obtaining appropriate permission before uploading images containing identifiable people, private documents, personal photographs, or other protected information.

6. Payments and Paddle

Payments may be processed by Paddle as merchant of record. Paddle may collect and use billing, payment, tax, device, and fraud-prevention information under its own privacy notice and buyer terms. Fogeni receives transaction status and limited billing details needed to activate subscriptions, allocate credits, provide receipts, handle support, and maintain financial records.

7. Cookies and similar technologies

We may use necessary cookies to keep users signed in, secure accounts, remember preferences, maintain sessions, and operate checkout. We may also use analytics or performance technologies where permitted.

Where required by law, non-essential cookies will be used only after consent. Users can control cookies through browser settings, although blocking necessary cookies may prevent parts of the Service from working.

8. Data retention

We retain personal information for as long as reasonably necessary to provide the Service, maintain the account, fulfill transactions, protect security, resolve disputes, and comply with legal, accounting, and tax obligations.

Uploaded and processed images remain associated with the user’s private account until deleted by the user, removed under available account controls, or deleted in accordance with our retention and account-closure processes. Residual copies may remain temporarily in backups, logs, or provider systems before secure deletion.

Transaction, invoice, fraud-prevention, and legal records may be retained for longer periods where required by law or reasonably necessary to establish or defend legal claims.

9. Security and account separation

We use reasonable administrative, technical, and organizational safeguards designed to protect information. These may include access controls, authentication, encryption in transit, private storage, logging, and account-level authorization checks.

Each uploaded or edited photo must be associated with the unique ID of the user who owns it. Access requests should be verified on the server, not merely hidden in the interface. No security system is perfect, and we cannot guarantee absolute security.

10. International data transfers

Fogeni and its service providers may process information in countries other than the country where the user lives. Where required, we use contractual or other recognized safeguards for international transfers. By using the Service, you understand that information may be processed in jurisdictions with different data-protection laws, subject to applicable legal requirements.

11. Your privacy rights

Depending on your location, you may have rights to:

  • request access to personal information;
  • correct inaccurate information;
  • request deletion;
  • restrict or object to certain processing;
  • receive a portable copy of certain information;
  • withdraw consent where processing is based on consent; and
  • complain to a competent data-protection authority.

12. Account and image deletion

Users may request deletion of their account or private images through available account controls or by emailing `help@fogeni.com`. Deleting an account does not automatically erase records that must be retained for legal, tax, fraud-prevention, dispute, or security purposes.

13. Children’s privacy

The Service is not directed to children under 18, and we do not knowingly allow children to create paid accounts. If you believe a child has provided personal information, contact us so we can investigate and take appropriate action.

14. Third-party links

The Service may link to third-party websites or services. Their privacy practices are governed by their own policies, not this Privacy Policy.

15. Changes to this Privacy Policy

We may update this Privacy Policy to reflect changes in the Service, law, or our practices. We will update the effective date and provide additional notice where required.
